Life Expectancy and the Medicare Set-Asides (MSA)

One of the key components to the MSA is the calculation of life expectancy. This life expectancy is then used when developing the future care plan to determine frequency of care and aid in the calculation of the cost for the allocated care.

In January 2022, the Centers for Medicare & Medicaid Services (CMS) released Workers' Compensation Medicare Set-Aside (WCMSA) Reference Guide version 3.51 (Guide) to "clarify" the use of non-submit (or evidence-based Medicare Set-Asides) when settling future medicals. However, the language used in the Guide had quite the opposite effect, increasing confusion for many regarding the use of these allocations.
